Standardized Operating Procedure for Purchasers of Real Estate Pursuant to Real Property Law 442-

Pursuant to Real Property Law Subdivision 4 Section 442-h, as amended on March 15, 2022 in legislature bills numbers S.2131-A and A.6186 the following standard operating procedures are adopted:
 

Z/Max Real Estate LLC has adopted the following Standardized Operating Procedure, as required by New York State Law for all purchasers of Real Estate. This standardized operating procedure applies to all of those that decide to utilize the services of Z/Max Real Estate LLC. 
 

Please be advised that Z/Max Real Estate LLC: 1. Does not require prospective buyer clients or customers to provide identification in order to view properties. Buyers should be aware that at some time during a transaction that identification may be requested by the parties to a potential contract of sale. 2. Does not require perspective buyer clients or customers to enter into an Exclusive Buyer Representation Agreement in order to view properties. Buyers should be aware that a discussion, with our licensee, regarding the potential benefits of exclusive representation as an option to non-exclusive representation, since it is the choice of the buyer, as to what type of representation they desire may be reviewed. Also, buyers may at any time during the process request exclusive buyer representation. Signing, as required by New York State Law, of the New York State Disclosure Form (Agency) or the New York State Housing Discrimination Disclosure Form does not constitute an Exclusive Buyer Representation Agreement. 3. Does not require perspective buyer clients or customers to provide a pre-approval for a mortgage loan or proof of funds in order to view properties. Buyers should be aware that a pre-approval for a mortgage loan and or proof of funds is usually required by sellers at the time of presenting an offer. Buyers should also be aware that a discussion, with our licensee, of the benefits of a pre-approval may be discussed as an option to more accurately identify the affordability index or price range they should be searching in, both as a time management tool as well as providing the best opportunity to find their desired home. Although Z/Max Real Estate LLC does not require a pre-approval to show perspective buyers a property, some sellers may require one prior to viewing their property or for an offer presentation.

What is a Buyer's Representative?   

A real estate buyer's representative represents the buyer who is purchasing
property in a real estate transaction. 
The buyer's representative works for, and owes
fiduciary responsibilities to the buyer, and has buyer's best interests in mind throughout
the process.
 

A buyer's representative will evaluate the specific needs and wants of the buyer and locate
properties that fit those specifications, including schools, neighborhood info, transportation,
shopping, etc. Also, assist the buyer in determining the amount that they can afford (pre-qualify),
and show properties in that price range and areas, and  accompany the buyer on
all showings. 
 


The buyer's representative will research the selected properties to identify any problems
or issues to help the buyer make an informed decision prior to making an offer to purchase
the property, plus advise the buyer on structuring an appropriate offer to purchase the
selected property. 

Present the offer to the seller's agent and the seller on the buyer's behalf, and will
negotiate on behalf of the buyer to help obtain the identified property -- keeping the
buyer's best interests in mind all the time. 

Assist the buyer in securing appropriate financing for the selected property, and
provide a list of potential qualified vendors (e.g. engineers, attorneys, movers, etc.). 

Your buyer's agent will fully-represent the buyer throughout the transaction.  Would you like
